DURING YOUR VISIT

Please remove your footwear upon entering the yurt.

Children must be under adult supervision at all times.

Please use the compost and recycling containers.

Blankets, quilts, pots and pans are to be used inside the yurt.

POOL and HOT TUB

No lifeguard on duty. Use at your own risk.

No food or glass is allowed in the area.

Please put away any materials you have used.

Pool and Hot Tub close at 10:00 PM

No outdoor amplified music.

PRIVACY and QUIET

Farm Quiet time 10:00 PM- 8:00 AM

Please respect the privacy of our neighbors and other guests on the property. 


CHECK OUT

Consult the Check-out guidelines in the House Manual for specifics. Clean all dishes and areas you have used. Put away the clean dishes. Place used linens and towels in the tub. 

Check-out is at 11:00 AM at the main farmhouse. You can pay for any products you may have purchased with PayPal, credit card, cash, or check.

PROBLEMS: Please contact us immediately if you encounter any problems with the yurt, have an accident, or damage anything. We will do our best to resolve the issue but we really need to know about it immediately in order to do so.

LONG VERSION

In order to maintain insurance our insurance company requires an Assumption of Risk – Release of Liability & Indemnification Agreement as specified in the agreement below. We apologize in advance for length and wordiness.

SHORT TERM RENTAL AGREEMENT  

This short-term rental agreement is between Cair Paravel Enterprises, LLC (hereafter “Cair Paravel”), the landlord, and the Primary Guest specified in the Airbnb reservation request (hereafter referred to as “Primary Guest”).

By making this Airbnb reservation the Primary Guest accepts this short term rental agreement.

The dates of this agreement are the reservation dates. Incorporated by reference into this short term rental agreement is the accommodation address and owner information in the House Manual in this Airbnb listing.

Assumption of Risk – Release of Liability & Indemnification Agreement:

By signing this Agreement, you are aware of and assume the risk for yourself, any children, and for all guests or invitees during your stay at Cair Paravel. Cair Paravel is not responsible for any accidents caused by Guest and all individuals in Guest’s party. You also agree to indemnify and hold harmless Cair Paravel from any and all liability resulting from harm or injury caused by Guest and all individuals in Guest’s party using Cair Paravel’s pool and/or spa and equipment.

By completing the Airbnb reservation the Primary Guest acknowledges and agrees to comply with this agreement.

Additionally, Primary Guest shall comply with the following requests and/or instructions:

LODGING CONDITION/DAMAGE: Primary Guest is responsible for ensuring that the accommodation is maintained in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. Primary Guest shall be liable for any damages caused by his or her own acts and omissions (including without limitation failure to timely vacate the accommodation) and also for the acts and omissions of any individuals that Primary Guest invites or otherwise allows into the accommodation.

- The Guests shall pay for any damage done to the premises over and above normal wear and tear.

ANIMALS/PETS: No animals or pets of any kind are to be brought onto the premises.

ADDITIONAL GUESTS: People other than those listed in the Airbnb reservation may not visit or stay overnight in or on the property. Any other person in or on the property is the sole responsibility of the Primary Guest. The Guests shall not sublet the property.

APPLIANCES: Only use appliances for their intended uses. Guests are advised that the property may contain a gas stove and cook top, gas heating, gas grill, and other gas powered items and will seek help from Cair Paravel if the proper operation of such items is not fully understood.

DEFECTS/DAMAGE: Immediately notify the landlord of any defects or dangerous conditions in and about the premises of which the Guests becomes aware.

ACCIDENT/ILLNESS: Cair Paravel is not responsible for any accidents, injuries or illness that occurs while on the premises or in its facilities. Cair Paravel is not responsible for the loss of personal belongings or valuables of the guests. It is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

PEACE AND QUIET: Guests and landlord are entitled to quiet enjoyment of the premises. Guests will not create a nuisance by annoying, disturbing, inconveniencing, or interfering with the quiet enjoyment and peace and quiet of landlord or any other nearby residents and guests.

NATURE TRAIL: Disclaimer: Although every effort has been made to present accurate details of trail conditions, due to changes by man and nature we expressly disclaim any legal responsibility for the conditions of any trail. Hikers assume the risks inherent in this outdoor activity and must respect the legal and safety guidelines for a safe visit. Good judgment, common sense, proper gear and clothing, and careful planning should prevent any mishaps on the nature trail. If you encounter ant wildlife move away from it. Do not try to feed, pet, capture or kill it.

FARM ANIMALS: Do not enter the barn or fenced areas without a member Cair Paravel Farm. Children must be accompanied by and under the direct supervision of an adult, not a Cair Paravel employee, at all times. Be aware that all fences may be electrified and produce a great shock. We are very concerned with the safety of our guests and animals. It is important for us to maintain the integrity and health of our flocks and herds. We have Great Pyrenees guard dogs in the pastures with our animals. They would like to be pets, but are working dogs and as such will protect the “herd” as much as necessary. The other livestock are not pets. Although they are domesticated there are risks that are inherent with any interaction with livestock. Our apiary is located in the middle pasture within the perimeter electrified pasture fence close to the solar array at the main farmhouse in a separate enclosure. Please do not disturb them or get in their flight path. If you have allergies please remember to bring materials that have been prescribed for you by your physician. 

FIREPLACE: The fireplace is a non-vented propane gas log fired firebox.  Please do not throw any paper or other combustible materials in the fireplace.   Fireplaces are turned off from Mid- April to early October; they are not operational during this time of the year.

FIRE PIT/CHIMERA: Some accommodations have an area for an open fire. Burn only dry seasoned wood. Keep fires small and controlled. Do NOT use gasoline, kerosene, diesel fuel, lighter fluid or alcohol to light or relight fires. If you are inexperienced in lighting and maintaining an outdoor fire ask Cair Paravel for assistance. No outdoor fires during restricted time, dry weather with fire danger, and windy days. Use in accordance with all applicable local, state and national codes. Extinguish all fire and coals with water prior to leaving the open flame. Never leave open flame unattended.

WATER AND SEPTIC: Cair Paravel is on a well and septic systems.  During a drought, please be judicious of your water use.  Make certain the dishwasher is full or do the dishes by hand. The septic system is very effective; however, it will clog up if improper material is flushed.  DO NOT FLUSH anything other than toilet paper.  No feminine products should be flushed at anytime.  If it is found that feminine products have been flushed and clog the septic system, you could be charged damages of up to _____________.

ACCESS: Mountain roads can be curvy and steep. Gravel drives are well maintained; however, we highly recommend four wheel drive and/or chains during the snow months. We do not refund due to road conditions. We follow the AirBnB weather exemption clauses.

INSPECTION- The Owner has the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Guests violate any of the terms of this agreement, the rental period shall be terminated immediately. The Guests waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Guests shall vacate the premises at the expiration time and date of this agreement. The Guests shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Owner as being immediately habitable by the next guests. Guests shall pay for maintenance and repairs should the premises be left in a lesser condition.

POOL/SPA SAFETY
You are responsible for the safety of yourself, your children (if any), and all guests in your party.

Guest acknowledges that the safety of all adults and children depends on the Guest. The Cair Paravel’s pool is fenced or gated and there is no alarm on any entrance to the pool area. The gates should remain latched or chained at all times. *NOTE: There is to be NO Glassware allowed in or near the pool and spa. Do not put any scents, oils or additives in the hot tub. If you do use additives the hot tub will have to be drained and the filters replaced. You will be charged for the time the hot tub is unavailable as well as for the labor and materials needed to make the tub operational as well.


SUPERVISION: Your attentive supervision is absolutely required to avoid risk of serious injury and/or death. Pools and spas are serious safety risks and hazards – including injury and death – if not used with attentive care and caution.

CHILD SAFETY: Children who are not toilet trained may not use the pool or spa/hot tub. According to the CDC swim diapers are not effective. Never leave a child unsupervised near a pool, not even for a second. During social gatherings at or near the pool, appoint a designated adult to protect young children from pool accidents. Children must be watched closely while swimming. Do not use floatation devices as a substitute for supervision. Toys can entice young children into the pool area. When not in use, clear the pool area of all toys.

CHEMICALS: You hereby agree and accept the pool and spa contain necessary chemicals that can cause skin rashes, harm or discoloration of swimwear. Guest and all individuals in Guest’s party including guests and invitees agree they use the pool and spa completely at their own risk.

There is NO LIFEGUARD on duty at any time. There is absolutely NO diving allowed- even in the deeper areas. (Diving into shallow water can cause serious injury, paralysis or even death.) There is also NO running near or around the pool or spa areas. 

SPA: Please avoid immersion in the spa for prolonged periods of time. According to APSP “No young child should be allowed in a hot tub until they can stand on the bottom and have their head remain completely out of the water. Children who are big enough to be in a hot tub should not use it for more than five minutes at a time, especially at the maximum temperature of 104 degrees.” DO NOT STAND ON THE HOT TUB COVERS.  Hot tub covers are for insulation purposes and are not designed to support a person or persons.  They will break and you may be charged for replacement. Remember when not using the hot tub, leave cover on so hot tub will stay warm. If you adjust the temperature of the spa/hot tub return it to 102 degrees when you leave.

ALCOHOL USE IN POOL AND SPA: Consuming alcoholic beverages and/or drugs and use of the pool or spa can be dangerous and cause serious health risks. Also, excessive drinking in or near the pool and/or spa may result in behavior that may cause serious physical accidents.
